Biography
Brian H. Leinhauser is a founding Partner of MacMain Leinhauser, a West Chester, Pennsylvania law firm that serves clients in the Keystone State, New Jersey, and throughout the United States. He provides legal counsel and defense for labor and employment matters, education law, business, civil rights, litigation, and non-profit administration. In this work, Brian serves employers, government entities and officers, educational institutions, businesses, religious institutions, and non-profit organizations.
Pennsylvania Employment Defense and Counsel
Brian’s employment law experience includes representing public and private entities, as insurance defense counsel or privately retained, in matters relating to labor relations, collective bargaining negations, personnel and human resources consultation, employment discrimination claims, internal investigations, and general litigation matters.
Brian represents employers and individuals in defense of discrimination and harassment cases, administrative agency complaints filed with state and federal agencies, employment contract disputes, employee benefits litigation, and heart and lung issues. He also counsels and defends clients in disputes related to the Pennsylvania Wage Payment and Collection Law and Fair Labor Standards Act (FLSA) collective actions.
Business Litigation and Civil Rights Defense
Brian counsels private sector business and non-profit entities, including religious institutions, in general consultation matters related to employee issues, corporate governance, real estate, and contract formation and compliance. He also defends these entities, municipalities, and law enforcement and corrections officers in individual and class action litigation matters, including defense of civil rights complaints.
Coverage and Oversight Counsel for Carriers in Litigation Matters
Brian Leinhauser has worked as associating counsel for carriers in Pennsylvania and New Jersey overseeing high exposure claims, assisting and managing excess carrier risk assessment, and arbitrating and litigating coverage and bad faith claims related to these matters involving policies covering public entities, schools, municipalities, non-profit and church entities, and businesses. He works to provide practical and efficient analysis of the underlying claims, the potential exposure of same, and advises carriers to ensure that they avoid allegations of bad faith where possible, and provides defense to such claims where necessary to protect the interest of the carrier.
Counsel and Representation for Educational Institutions
Attorney Brian Leinhauser represents private and public educational institutions from K-12 public schools to universities and colleges in all phases of their existence. He advises these clients on state and federal law compliance, including Title IX and Title VII. Brian manages and conducts internal investigations and guides clients on how to address student disciplinary investigations and hearings following the directives from state and federal departments of education and the US Department of Education’s Office for Civil Rights. Brian helps formulate policies and practices related to Title IX and student health and safety issues for clients.
Brian also assists charter schools in applications for new charters, hearings before local boards of school directors, appeals to the Pennsylvania Department of Education’s Charter School Appeal Board (CAB), and defending non-renewal and revocation proceedings. He provides education institutions with advice on legal issues that can lead to disputes, including regulatory compliance, real estate, employment, special education, sexual misconduct allegations and investigations, and governance. When issues do arise, Brian is a strong ally for his clients facing education law litigation.
Sharing His Legal Experience and Knowledge
Brian has spoken at conferences and seminars advising private and public employers in best employment practices, policy review, and matters involving employment discrimination claims. He advises school clients on policies regarding student contact and assists in disciplinary investigations and Title IX and VII enforcement as well as special education matters.
Brian has been published in the Defense Research Institute’s (DRI’s) For the Defense on “The Changing Landscape of Labor Relations,” addressing the various pitfalls that face employers with and without a unionized workforce and how to maintain a positive working relationship with employees and their union representatives while maintaining a profitable and productive work environment.
Brian Leinhauser’s Education and Experience
Brian worked his way through college with the help of his family. After graduating from Villanova University, Brian studied as a Seminarian with the Order of Saint Augustine, exploring his possible call to ordained ministry. After leaving the seminary, Brian continued his theology studies at Duquesne University and later taught religion and math in the Archdiocese of Philadelphia.
After teaching, Brian pursued his Juris Doctor degree at the Thomas R. Kline School of Law of Duquesne University. Upon graduation, he accepted a position at the law firm of Campbell, Durrant, Beaty, Palombo & Miller P.C., focusing his practice on public sector labor and employment counsel and litigation.
In 2007, Brian joined the law firm of Lamb McErlane, where he was an associate in the Appellate Litigation and Labor and Employment practice groups. In April 2013, Brian, along with Partner David J. MacMain founded the firm that would become MacMain Leinhauser.
