After more than forty years representing individuals and companies in complex commercial litigation, I am convinced that in 90% of the cases, there is a better, less expensive, more flexible way of resolving disputes - mediation or arbitration.  In mediation, parties preserve their privacy and their flexibility in crafting solutions that are private, more personalized and more likely to be commercially reasonable.  In arbitration, the parties can realize decreased expense, faster resolution, and privacy in the result and process so they can put the dispute behind and move on with their business.  That
