Biography
James J. Waldenberger is a partner at Kline & Specter, P.C. who has a wealth of hands-on experience in personal injury cases. Since coming to Kline & Specter, Waldenberger has been involved in a litany of major cases, work that has earned him inclusion in the 2017 and 2018 editions of the peer-review publication Best Lawyers in America.
He has been involved in a litany of major cases, including as lead counsel in five cases that produced seven-figure results.
In late 2015, Waldenberger had back-to-back legal victories. The first was a $1.4 million jury verdict in Philadelphia for a man who died after doctors missed bone cancer in an X-ray of his right knee, leading to a spread of the cancer. In the second case, Waldenberger secured a $1 million settlement – despite a $500,000 government liability cap -- from the City of Williamsport, Pa., for the family of a man who died after a police car smashed into his vehicle. The city also agreed to make changes in police pursuit procedures and the offending officer was fired.
In 2013 and 2014 alone, Waldenberger was lead counsel in a half dozen cases that produced seven-figure cases included a $5.5 million jury verdict in Philadelphia Common Pleas Court for a mentally disabled man who was left a quadriplegic after the commercial van in which he was riding struck a utility pole. In another case, Waldenberger negotiated a $2.6 million settlement for a garbage collector who suffered severe face and neck injuries when he was burned by acid after a pick-up at a plumbing supply store.
Three other cases that produced substantial settlements involved medical malpractice, premises liability and workplace litigation, the last involving the death of a factory worker who fell into an industrial tank because of inadequate safety measures at the plant.
Waldenberger also won a $3 million Philadelphia jury verdict for a woman who suffered nerve damage as a result of a missed colon cancer diagnosis, a verdict which placed in the top verdicts of 2012 in Pennsylvania.
In earlier cases, Waldenberger settled two matters for more than $5 million each. In one, a man suffered catastrophic brain injuries when his car was struck by a 36-ton dump truck in Delaware County, Pa. In the other, he had filed suit against the designers and builders of an industrial factory where an improper platform and equipment layout resulted in a worker being struck.
Waldenberger in 2009 filed suit against the Philadelphia Department of Human Services for the improper placement of a five-year-old girl in a home for which the department failed to perform an adequate background check. The girl was raped by another child at the home. The case settled for $2 million.
Later in the same year, Waldenberger reached a $3 million settlement for the family of a cement truck driver who was killed after the vehicle struck a ditch and the mixer dislodged and crushed him.
Waldenberger received his undergraduate and law degrees degree from Villanova University. In law school he was a member of the National Moot Court Team.
He is a Fellow of the Academy in Trial Advocacy and a member of the bar in Pennsylvania, New Jersey and the U.S. District Court for the Eastern District of Pennsylvania.
