Biography
Mr. Penland is an experienced litigator and active trial attorney with over forty years of continuous practice who has handled hundreds of complex civil litigation matters, including jury trials, bench trials, appeals, and complex negotiations since 1975. Mr. Penland's special talent is in representing individuals in matters involving complex financial issues and difficult emotional issues between the parties, such as high stakes partnership disputes, and business disputes. He also represents peripheral parties in major business litigations.
Mr. Penland litigates and consults on attorney fee and abusive litigation issues at the trial level and appeals in the appellate courts. Mr. Penland is a recognized speaker and authority on the law and procedure of Attorney Fees in Georgia. He lectures at the annual seminar on Abusive Litigation presented in February of each year by the Georgia Institute of Continuing Legal Education. He speaks on the elements, intricacies, and pitfalls arising under Georgia's expression of the "American Rule" for awarding attorney fees in litigation as expressed in the Georgia Statutes O.C.G.A. §13-6-11 and O.C.G.A. §9-15-14.
