Biography
Kai Li Fouts is the Managing Partner in the law firm of Eisenberg & Fouts, P.A. located in downtown West Palm Beach, Florida. Ms. Fouts practices exclusively in the areas of criminal defense in both state and federal courts, and Marchman Act law, and has an Martindale AV Peer Review Rating. Ms. Fouts graduated from the University of Wisconsin-Madison in 1991 with a Bachelor of Arts Degree with a double major in Communication Arts, Radio-Television-Film and Political Science. She, thereafter, attended law school in New York at Syracuse University, College of Law, graduating with a Juris Doctor in 1995.
During the summer after her second year of law school, Ms. Fouts worked with William J. Sheppard, Esquire, in Jacksonville, Florida, one of the most prestigious criminal, civil rights attorneys in Florida. After graduation from law school, Ms. Fouts began the practice of law with the Office of the Public Defender in Palm Beach County. While there, Ms. Fouts was not only fortunate to have tried cases in both the felony and misdemeanor trial division, but she also wrote several appeals before the Fourth District Court of Appeal while in the appellate division. In 1999, Ms. Fouts was the first associate to practice with James L. Eisenberg, P.A. In 2003, Ms. Fouts was named partner and the firm became what is now known as Eisenberg & Fouts, P.A., and she continues to practice in the areas of criminal trial and appellate work and Marchman Acts.
Since entering the practice of law, Ms. Fouts served on the Board of Directors of the Palm Beach Association of Criminal Defense Lawyers and was honored to represent that organization as a member of the Palm Beach County Criminal Justice Commission. She was elected and served as President of the Palm Beach Association of Criminal Defense Lawyers for the 2015-2016 year. She has previously served on the Board of the Craig S. Barnard, American Inn of Court LIV as Secretary and as Director of Membership and continues today as an Emeritus Member. Ms. Fouts also served as a Florida Bar appointed attorney member of the Fifteenth Circuit Unlicensed Practice of Law Committee. Since 2010, Ms. Fouts has served as a volunteer advocate for the Palm Beach County Commission on Ethics. In February, 2011, Ms. Fouts was appointed by Chief United States District Judge Frederico A. Moreno as an attorney member of the Federal Magistrate Judge Merit Retention Panel, and in April, 2011, as an attorney member of the Federal Magistrate Judge Merit Selection Panel. In May, 2012, Ms. Fouts was recognized by the Legal Aid Society of Palm Beach County, Inc., The Florida Supreme Court and the Florida Pro Bono Coordinators Association and received a special commendation for her pro bono work in the year of 2011, and in 2013, she was honored to receive the "And Justice For All Award". Ms. Fouts served as the Chair of the Florida Bar's 15th Circuit (15A) Unlicensed Practice of Law Committee through 2016. In 2015, Ms. Fouts was a Co-Chair of the Criminal Law Section for the Palm Beach County Bar Asosciation’s Bench Bar Conference and the following year she was asked to be a Co-Chair for the entire Palm Beach County Bar Association's Bench Bar Conference. Ms. Fouts served from 2017 thru 2020 as a committee member for The Florida Bar’s Fifteenth Circuit’s Grievance Committee ”F.” In 2017 until 2020, Ms. Fouts worked with the Palm Beach County Criminal Justice Commission’s Core Workgroup for the MacArthur Foundation’s Grant to reduce the jail population and racial and ethnic disparities in Palm Beach County.
Other community involvement includes her commitment to the Hanley Foundation’s efforts to raise money to fund education and prevention of substance abuse in Florida’s public and private schools. She has served as a committee member, a Co-Chair, and an Honorary Chair for their Annual Family Picnic. She is honored to serve as President and Board Member for the Young Singers of the Palm Beaches, which teaches children through music the importance of breaking down social barriers, developing life skills, providing outlets for creativity, and fostering good citizenship. Additionally, she is a dedicated President of Dance Theater of Florida, an organization committed to providing access to dance and the performing arts for the underserved.
In 2017, Ms. Fouts became the sole owner and Managing Partner of Eisenberg & Fouts, P.A., upon the retirement of her beloved career-long law partner, James L. Eisenberg. Mr. Eisenberg remains Of Counsel to the firm, and is a cherished friend and mentor.
Ms. Fouts is happily married to Christopher R. Jette, a Shareholder at Nason Yeager Gerson Harris & Fumero, P.A., and practices in the area of Marital and Family Law Litigation. Together they has three amazing performing arts children, all of whom are now young adults in college. Ms. Fouts actively practices the Korean Martial Art of Tae Kwon Do, is an avid Wisconsin Badger Fan, and lives in Palm Beach County.
