Kyle David Mott's Reviews
RUINED MY LIFE
reviews are about Lubin Pham Caplin (LPC) doing lightweight legal work or providing an initial consultation. Any decent attorney can do that by writing a strongly worded letter or making a few phone calls to solve a conflict. However, I don't see any reviews about a client going through years of a litigation nightmare like I did with them. So, I have a very different perspective. I have solid evidence to back up every claim I'm making in this review. Hiring them was the worst mistake of my life. My case was handled by a newbie attorney who had just passed the Bar Exam mere weeks before. His meekness and inexperience proved to be a disaster. He was even sanctioned by the judge for $1500. LPC didn't tell me about the sanction. A friend of mine who is a retired judge said that getting sanctioned is a red flag, and it never looks good in the eyes of a judge. I was offered a settlement for a "paltry $20,000" (the newbie attorney's words, not mine). He and the LPC partner did not even bother to proofread the settlement offer. It had the incorrect County, and unbelievably, it did not include one of the main reasons I was suing the Defendant in the first place. Because I felt I had been wronged by LPC, I filed a complaint with the State Bar. The State Bar Investigator suggested I contact an attorney specializing in legal malpractice or go through fee arbitration. I opted for fee arbitration as this was the only viable option for me financially because this case wiped out my savings. It's a good thing I did go through fee arbitration: I prevailed with the three arbitrators (one of whom even stated--in front of the LPC attorneys, the other two arbitrators, and my witness--that there may have been "some legal malpractice involved"). Fortunately, I did not have to pay LPC the thousands of dollars remaining on my bill. At least there was some justice. A shocking revelation was when I found out one of the partners had a DUI and drunk driving accident, thanks to a one-star Yelp review posted on November 26, 2024 (that has since been deleted). The review stated the partner was suspended by the California State Bar. Fortunately, I have screenshots of the post, as well as one of the other partner's response defending his partner's irresponsible actions (posted December 18, 2024). I do not condone this morally reprehensible, heinous behavior. At the age of seven, my childhood best friend lost her mother to a drunk driver. My uncle was hit head-on by a drunk driver and died a month later. My cousin, a state trooper in Massachusetts, died after being hit while on duty by not one but two drunk drivers on the night of his son's graduation from middle school. I choose not to drink. I never would have hired this law firm had I known of the partner's DUI. That's how strongly I feel about driving while intoxicated. LPC never disclosed this information about the partner's DUI. Doing an Internet search will yield the Public Matter findings about the partner from the State Bar Court of California Review Department (Case #17-C-05405). I also never would have hired a law firm that has a partner who is on record for telling lies or has had questionable judgment. Clients want an attorney they can trust. The partner with the DUI was suspended by the California State Bar and was found to have committed "moral turpitude" due to his lying to police officers. Why would anyone hire an attorney who committed moral turpitude? In my opinion, this demonstrates very questionable judgment by the other partners and everyone who works at LPC. The partner was found guilty of lying to the police, not once, not twice, but seven times. This is disgraceful and erodes client confidence. What the attorneys at Lubin Pham Caplin did was unforgivable. They were not upfront with me about my case. They did not manage my expectations. They were not truthful about legal strategies. They refused to do crucial discovery that would have changed the outcome drastically. They almost ruined my marriage. They ruined my savings. They ruined my health--physically, emotionally, and mentally. They ruined my faith in attorneys. They ruined my life.
