Biography
MICHAEL A. MORSE serves as Chair of the Qui Tam Practice Group.
Mr. Morse is also a member of the Government Enforcement, Compliance, and White Collar Litigation Group as well as the Health Care and Litigation Practice Groups.
He served as an Assistant District Attorney in the Philadelphia District Attorney's Office from 1997-2000. As an Assistant District Attorney, Mr. Morse handled hundreds of felony cases, and briefed and argued numerous cases before the Pennsylvania Supreme and Superior Courts.
Mr. Morse has developed a nationwide practice representing whistleblowers, under federal and state false claims acts, who report fraud committed against the government by corporations and individuals. He represents whistleblowers from across the United States who have exposed fraud against the federal and state governments in the areas of: pharmaceutical sales and marketing; health care; defense contracting; finance; construction; research; and government procurement.
Mr. Morse was counsel for the lead whistleblowers in a number of the most successful false claims cases in United States history, including:
- United States ex rel. Michael Epp v. Supreme Foodservice AG, 10-1134 (E.D.Pa.) (resulting in a $389 million civil and criminal recovery for federal taxpayers)
- United States ex rel. Monahan v. St. Barnabas Health System, 02-5702 (D.N.J.) (resulting in a $265 Million recovery for federal taxpayers)
- United States ex rel. Hunt and Gauger v. Medco Health Solutions, 00-737 (E.D.Pa.) (resulting in a $185 Million recovery for federal and state taxpayers)
- United States ex rel. Mason v. Community Health Systems, Inc. et al., No. 12-817 (W.D.N.C.) (resulting in a $98 million recovery for federal and state taxpayers)
- United States ex rel. Novick v. Doshi Diagnostics, 09-4992 (D.N.J.) (resulting in a $15.5 Million for federal and state taxpayers)
- United States ex rel. DePace v. Cooper Health System, 08-5626 (D.N.J.) (resulting in a $12.6 Million recovery for federal taxpayers)
- United States ex rel. DiMezza v. Boeing Corp., 10-634 (E.D.Pa) (resulting in a $4.4 Million recovery for federal tax payers)
- United States & State of Texas ex rel. Hudnall v. Rescare, 3:01cv1154-H (N.D.Tex.) (resulting in a $2.15 Million recovery for federal and Texas taxpayers)
Mr. Morse also defends corporations, executives, public officials, hospitals, device manufacturers, and health care providers in criminal and civil fraud matters in federal and state courts across the U.S. He defended a physician charged with 82 counts of health care fraud, who was acquitted of all charges following a three-week jury trial in federal court.
Mr. Morse advises hospitals, health systems, medical schools, physicians, health care practices, device manufacturers and executives of pharmaceutical companies throughout the U.S. in contracting, compliance, regulatory, antitrust and fraud and abuse matters. He regularly conducts internal fraud and compliance investigations for private and publicly-traded corporations. Mr. Morse also speaks regularly to audiences across the country on fraud, abuse and compliance matters.
Mr. Morse has represented clients in a wide-variety of complex litigation matters, including: protecting a publicly traded company against the misappropriation of its trade secrets; defending a large semi-conductor manufacturer against allegations of patent infringement; defending public and private employers in state and federal courts against allegations of wrongful termination and discrimination; defending a former executive against allegations of securities fraud involving a multi-billion dollar international finance company; and defending a large municipality against allegations of civil rights violations.
Mr. Morse is a member of the American, Pennsylvania, New York and Philadelphia Bar Associations, as well as the American Health Lawyers Association, the Health Care Compliance Association, the National Association of Criminal Defense Lawyers, and the Pennsylvania Association of Criminal Defense Lawyers. He currently serves as the Co-Chair of the Philadelphia Bar Association's Federal Courts Committee. He also has served as a member of the editorial board of the American Bar Association's Criminal Litigation newsletter, and a member of the Steering Committee of the American Bar Association's Mid-Atlantic White Collar Crime Committee.
Mr. Morse has been selected as a Pennsylvania Super Lawyer for 2013, 2014, 2015, and 2016 in the area of White Collar Criminal Defense. Previously, he was selected as a Pennsylvania Super Lawyers Rising Star for 2005 through 2008 and 2010 through 2012 in the area of White Collar Criminal Defense. He has also been selected by The Legal Intelligencer as a Lawyer on the Fast Track for 2010.
