Biography
Reesa Benkoff has over 15 years of experience practicing exclusively in health law and transactional law. Reesa graduated Cum Laude from the Boston University School of Law and she holds a Bachelor of Business Administration, with High Distinction, from the University of Michigan’s Ross School of Business. She has practiced law in both large and small law firms, where she dedicated her career to providing health law services to a wide variety of national clients, from solo practitioners to the nation’s largest health systems. Reesa devotes her time to providing creative and compliant solutions in an efficient and cost-effective manner for health care industry clients.
Reesa counsels a wide variety of health care providers and entities including, without limitation, physicians, nurses, chiropractors, dentists, podiatrists, physical therapists, pharmacies, laboratories, home health agencies, hospices, hospitals, health systems, DMEPOS providers, physician-owned distributorships (PODs), ambulatory surgery centers (ASCs), diagnostic testing facilities, substance abuse providers and facilities, and wellness providers. In addition, Reesa advises non-healthcare entities that are important players in the health care industry including, without limitation, group purchasing organizations, physician organizations, physician hospital organizations, management service organizations (MSOs) and management companies, and private equity/venture capital investors in health care entities.
Reesa has successfully counseled clients on a variety of federal and state health law related issues nationwide including: federal and state fraud and abuse laws, the federal Anti-Kickback Statute and state anti-kickback laws, the federal Stark law and state self-referral laws, and the federal Eliminating Kickbacks in Recovery Act (EKRA); physician in-office ancillary service arrangements; corporate practice of medicine; scope of practice issues; licensure; credentialing and enrollment; HIPAA, 42 CFR Part 2, and state privacy laws; billing and reimbursement compliance; alternative payment models; telemedicine; substance abuse treatment; concierge medicine and private pay matters; elective medicine and wellness services; supply chain coordination, standardization, and purchasing agreements; transactional matters, employment agreements, independent contractor, and service agreements; real estate and equipment leases, acquisitions, and sales; membership agreements for GPOs, physician organizations and physician hospital organizations; corporate structuring and related agreements; mergers, acquisitions, sales and related due diligence in health care transactions; and many other health law-related matters.
In addition to counseling clients, Reesa holds and has held a variety of leadership positions in the State Bar of Michigan’s Health Care Law Section, the American Bar Association’s Health Law Section, and the American Health Lawyers Association, and Reesa is also a member of the Oakland County Bar Association. Reesa currently serves as Vice Chair of The Health Lawyer Editorial Board for the American Bar Association’s Health Law Section and previously served as Section’s Vice Chair for Publication Book Editorial Board, Vice Chair of the Business & Transactions Interest Group, and Vice Chair of the Physician Legal Issues Conference. Reesa has also served as a Lead Coordinator for the American Health Lawyers Association's Fraud and Abuse Practice Group and she participated in the Leadership Development Program for the American Health Lawyers Association's Physician Organization Practice Group. Reesa has been appointed to a second 3-year term on the State Bar of Michigan’s Health Care Law Section Council, which is the board that oversees the State Bar of Michigan’s Health Care Law Section. Additionally, she currently serves as the Section’s Chair of the Substantive Law Committee and has previously served as the Section’s Vice Chair of the Substantive Law Committee, Chair of the Substantive Law Committee, Chair of the Medical/Legal Substantive Law Subcommittee, Vice Chair of the Medical/Legal Substantive Law Subcommittee, and Vice Chair of the Payors Substantive Law Subcommittee.
Reesa has been named a Super Lawyer in 2022 and 2023 and she has been named a Rising Star by Super Lawyers in 2012, 2013, 2014, 2015, 2016, 2017, 2018, 2019, 2020, and 2021.
