Biography
I am a founding member of Flachsbart & Greenspoon, LLC. A registered patent attorney, I concentrate my practice in the litigation and trial of patent cases involving computer and electronic technologies. I have held primary litigation responsibility in matters grossing tens of millions of dollars in aggregate recoveries since 1996. I have also successfully defended against multimillion dollar claims while representing accused infringers. My cases have involved computer, computer network and electronic technologies of the highest complexity, but also simple mechanical devices.
I have argued numerous cases before the Court of Appeals for the Federal Circuit. At 29 years old, I became possibly the youngest attorney to argue successfully for a patentee-appellant in a multimillion dollar patent case (IMS Technology, Inc. v. Haas Automation, Inc., 206 F.3d 1422, 1430 (Fed. Cir. 2000)). I successfully argued HyperPhrase Technologies LLC v. Google, Inc. (Case No. 2007-1125), obtaining a ruling on December 26, 2007 vacating-in-part a lower court decision to throw out a patent case against Google. Most recently, I successfully argued 1st Technology v. Rational Enterprises (Case No. 2008-1132), obtaining an affirmance without opinion on October 8, 2008 which preserved a $50 million default judgment against Bodog, the online gaming company. I served in 1995-1996 as a judicial law clerk to the Honorable Brian Barnett Duff of the United States District Court for the Northern District of Illinois. I am a co-author of "Are Patent Trolls Really Undermining the Patent System?" in the September/October 2006 issue of IP Litigator, as well as "Obviousness after KSR v. Teleflex: a Private Practice Perspective" in the August/September 2007 issue of Intellectual Asset Management Magazine. Most recently I wrote "Is the United States Finally Ready for a Patent Small Claims Court," Minnesota Journal of Law, Science and Technology, Vol. 10, Issue 2 (Spring 2009).
