Biography
Tonya is an attorney with Murphy, Falcon & Murphy who has significant experience representing both plaintiffs and defendants locally in Baltimore and nationally.
Ms. Baña has an impressive record of success in litigation. She has prevailed, in whole or in part, on nearly every motion or brief that she has handled for more than a dozen cases, including complex Daubert motions that resulted in the exclusion of the opposing party’s experts or prevented adverse fact witnesses from testifying as experts.
In recent years, Ms. Baña successfully challenged the sufficiency of the defendant’s discovery responses in an age discrimination class action in federal court. The court not only granted her request that certain facts be deemed admitted, it also required the defendant to pay her attorneys’ fees. Ms. Baña’s results are especially noteworthy because the defendant was a local government and courts are particularly reluctant to award fees against governmental actors.
Before joining Murphy, Falcon & Murphy, Ms. Baña spent nearly a decade as an attorney counseling and defending companies in a variety of complex labor and employment matters at Miles & Stockbridge and Jones Day. She also clerked for the Chief Judge of the Maryland Court of Appeals, the Honorable Robert M. Bell, and worked as a trial attorney for the U.S. Equal Employment Opportunity Commission.
