Arbitration is an effective and efficient means of solving a dispute and is usually a provision that is incorporated in contracts signed by parties.

In arbitration, there is an arbitrator; one can be an arbitration attorney or some other judge-like person. It is the practice for the two parties to choose the arbitrator and be bound by the decision he or she makes.

It should also be noted that evidence as well as testimonies may be tendered before an arbitrator, and the decision made can be conclusive. While non-binding arbitration may be appealed, the same cannot be said of binding arbitration. Arbitration choices are made by the participants in the arbitration process concerning whether the decision made can be binding or not.

Do I Need a Lawyer for Arbitration?

It is in your best interest to seek the services of an attorney who has a lot of practice in arbitration with a view of the arbitration hearing. You do not have to be represented by a lawyer in the hearing.

It is even more beneficial to have a lawyer during the hearing session. The factors you have will be important when deciding whether to get an attorney. Include the following:

  • Financial significance of the dispute
  • Costs of arbitration
  • Your assets, money, and capability
  • It shall hold that opposition is or is not represented by an attorney

However, if you are not going to have a lawyer to represent you at the hearing, it would be wise to meet with a lawyer to prepare for the hearing.

Your attorney will be able to assess the issues and see whether they are favorable for arbitration after examining the facts and circumstances of the disagreement. In most practices, you are legally required to go to arbitration.

May assist you in walking through the procedure of arbitration so that you know your rights and responsibilities.

Assist you in the preparation of your evidence and choose your witnesses and prepare to testify before the hearing if you so wish.

Can assist in the preparation of documents concerning the provisions of arbitration and any other documents needed.

Your attorney may accompany you to duties through all the arbitration stages or be engaged in specific tasks only.
