Can I get a new phone with the same line of service on the insurance?

My phone was confiscated from me and the police. I was informed that I would get it back once the case has been concluded but that could take some time. I had my cell phone insured and therefore I just thought I could just go and claim that my phone got lost and have a new one issued to me.
