What is Lemon Law?

The name “Lemon Law” is often given to the law called the Magnuson-Moss Warranty Act which covers buyers of any product that comes with a warrantee and costs $25 or more. Most often, this piece of law gets used in the sale of cars with warranties, whether the cars are new or even used.

The act gives a product or component a reasonable number of repairs before the whole product has to be exchanged for a new one. Each state generally has its own lemon law and some of these differ from the federal law.

Should I Hire a Lemon Law Attorney?

You should work with a lawyer to protect your rights and submit your case on time as defined by the statue of limitations.

If your case is decided in your favor, the Magnuson-Moss Warranty Act means you can recover the money you spent on a lawyer and most states with a lemon law make this possible as well. The money will be taken out of your account later, not after your monetary award.

What Can a Lemon Law Attorney Do?

Your lawyer can tell you during the first appointment which may be free, if you have a valid legal claim. Federal law and state laws make it possible to apply the Lemon Law to used cars sold with warranties. A lawyer can help you figure out if this part of the law is relevant for you.

You should expect your attorney to request detailed documents related to the issues with the product, including what was done and fixed and the time it took for the repairs. These documents are crucial to proving your case. You can ask the car dealer or a repair shop for replacement copies if you’re missing some records.

Your attorney may get in touch with the product’s manufacturer while handling your Lemon Law claim. If the dealer or manufacturer does not respond, your attorney will file a case in civil law court and represent you all through the case. Negotiations can take place over your case, if you have a strong case and allow your attorney to handle them.
