Will both parents lose custody of the children in a divorce in Missouri to a third party, where there is no third party?
My ex and I are preparing to court, she says (and even has her mother agreeing) that we both can lose custody once we take it to court. I have nearly no gaps on my employment record over the past 11 years whereas she has perhaps worked 6 weeks in the previous 12 years. She has a boyfriend with convictions of 4 forms of assault and 3 forms of domestic assault and to me on text has stated to having what most would call serious drug problems (says he had a 2 year binge). Children's division has made it clear that they do not have a problem with me since she had been to my home on 3 occasions (all unproven), and that she was evicted out of her apartment and is living with her mom and that she has a voluntary case open with Children's Division because of unsanitary living conditions which was caused by the code enforcement that made her apartment unsanitary. I have been in counseling on a biweekly basis (once every 2 weeks) and taking prescribed medicines since I left because the counselor said he thought I did not need them any longer. Where she has a record of disability advocacy on the grounds of being bi-polar, has been diagnosed with severe anxiety, depression and mild schizophrenic tendencies. Would we both lose the kids?
